I acknowledge and agree to Montalvo’s Anti-Bullying Policy which is as follows. The physical and emotional safety of students and staff are central to Montalvo’s camps and vital to its overall mission. As such, we take the issues of bullying, harassment, and violence very seriously. Bullying is generally defined as when one or more people maliciously exclude, tease, taunt, gossip, hit, kick, or put down another. Montalvo’s leadership investigates any and all allegations of bullying, and trains camp supervisors to promote positive communication, so that students can feel comfortable voicing their concerns to staff.
Behaviors that may warrant suspension or dismissal in Montalvo’s sole discretion include, but are not limited to:
• Fighting or harming a teacher, volunteer, staff member or student
• Threatening to harm or using threatening language
• Swearing at a teacher or student
• Destroying camp property
• Bullying other students
• Actions which disrupt or interfere with the teacher’s ability to teach camp or engage with other students
I understand the hazards of the novel coronavirus (“COVID-19”) and am familiar with the Centers for Disease Control and Prevention (“CDC”), State of California, and County of Santa Clara guidelines regarding COVID-19. I acknowledge and understand that the circumstances regarding COVID-19 are changing from day to day and that, accordingly, the guidelines are regularly modified and updated and I accept full responsibility for being familiar with and adhering to the most recent guidelines and updates.
I agree to complete with the COVID-19 health checklist to be provided by Montalvo as a condition of my child being admitted to camp. I acknowledge and agree that my child shall wear a mask at all times except for prescribed brief periods for food and beverage and social distanced exercise breaks, and that he/she must follow any and all additional health and safety protocol for camp participants set in place at that time by Montalvo.
I acknowledge and fully assume the risk of illness, injury, harm or loss arising from my child being on the premises and hereby agree to release and discharge MAC, the members of MAC Board of Trustees, all officers, employees and agents of MAC from any and all liability, including any illness related to COVID-19 which might occur as a result my child being on the premises.
In addition, I shall defend (with attorneys acceptable to the indemnitee), indemnify, protect, and hold harmless MAC, the members of MAC’s Board of Trustees, all officers, employees and agents of MAC from and against any and all damage, loss, claim, liability and expense, including attorneys’ fees and legal costs, incurred directly or indirectly by reason of any claim, suit or judgment brought by or on behalf of any person or persons for damages, loss or expense arising from or out of, or relating to, directly or indirectly, the risk of or actual infection of COVID-19 or any other illness or injury, provided that this indemnity shall not apply to any damage, loss, claim, liability or expense caused by the sole negligence or willful misconduct of MAC or its Trustees, officers, employees or agents.
